Justice Nitin Wasudeo Sambre has been appointed as the Acting Chief Justice of the Delhi High Court following the elevation of the incumbent Chief Justice, Justice Devendra Kumar Upadhyaya, to the Supreme Court of India. Justice Sambre will assume the responsibilities of the office after Justice Upadhyaya relinquishes charge as Chief Justice of the Delhi High Court.
The appointment has been made under Article 223 of the Constitution of India, which provides for the appointment of an Acting Chief Justice when the office of the Chief Justice of a High Court is vacant or when the Chief Justice is unable to perform the duties of the office.
“In exercise of the power conferred by Article 223 of the Constitution of India, the President is pleased to appoint Shri Justice Nitin Wasudeo Sambre, Judge of the Delhi High Court, to perform the duties of office of the Chief Justice of that High Court with effect from the date Shri Justice Devendra Kumar Upadhyaya relinquishes the charge of the office of Chief Justice consequent upon his elevation as a Judge of the Supreme Court of India,” the notification says.
The development follows the appointment of Justice Upadhyaya as a Judge of the Supreme Court. His swearing-in ceremony is scheduled to take place tomorrow, following which he will formally take charge as a Supreme Court Judge.
Justice Sambre will accordingly take over the administrative and judicial responsibilities of the Delhi High Court as its Acting Chief Justice once Justice Upadhyaya demits office as Chief Justice consequent to his elevation.
