Delhi HC Rejects Plea Seeking Live Streaming Of Proceedings

The Delhi High Court has rejected a petition seeking live streaming of court proceedings, saying that in view of the phased implementation of the initiative and ongoing deliberations within the High Court committees, any judicial interference in the matter would be premature. The petitioner contended that the live streaming facility should also include recoding of court proceedings as it would enhance judicial transparency. The petitioner also asserted that recording of court proceedings would also deter Advocates from misleading the courts. 

In response to the petition, the Delhi High Court administration stated that live straeming facility was presently available in two court rooms only on account of logistical constraints involving development of IT infrastructure. Justice Sanjeev Narula said that Delhi High Court was actively involved in addressing logistical and infrastructural challenges associated with expanding live straeming facility and hence imposing any timelines without considering technical challenges and resource allocation would not be prudent. 

The court observed that since the live straeming facility is currently operational only in a limited scope and only in two courtrooms, the request to record proceedings cannot be allowed. The court also said that providing copies of recordings conducted on live streaming is governed by specific rules that are based on privacy concerns and permiting access without considering these factors could lead to misuse and also raise security concerns. The court observed," Accordingly, the present writ petition is dismissed, alongwith any pending applications, affirming the courts's confidence in the existing processes and the Delhi High Court's commitment to enhancing judicial transparency responsibly and judiciously".
