Advancing Gender Equality in the Legal Profession: A Call for Systemic Change

Speaking at a seminar, "Breaking the Glass Ceiling: Women Who Made It," organized by the University of Mumbai and the Indian Council of Social Science Research, Justice BV Nagarathna advocated for a 30% reservation for women in State as well as Central government legal panels and public sector advisory roles, addressing the persistent gender disparity in the legal profession.

She emphasized the need for increased representation of women in judicial appointments, particularly in High Courts, where competent women under 45 are often overlooked despite their male counterparts being appointed at similar ages.

Highlighting the contributions of pioneering women in law, like Cornelia Sorabji, Regina Guha, Justice Anna Chandy, and Justice Fathima Beevi, she acknowledged their struggles in breaking professional barriers. Justice Nagarathna also recognized ‘unsung women’, such as Asha workers and homemakers, who contribute significantly to society without formal recognition.

Underscoring the importance of women's education and workforce participation, Justice Nagarathna addressed key challenges such as the ‘motherhood dilemma’ and ‘husband dilemma,’ which often hinder career progression. Stressing the need for a societal shift, she urged for dismantling outdated gender stereotypes to ensure equal opportunities for women in professional spaces.
