Bombay HC Expands Concept of Women's Modesty U/S 509 IPC, Refuses to Quash FIR
Judge Robert Linford has gone viral for his scathing rebuke during the sentencing of John Cann and Ryan Bailey, who participated in a violent disorder in Plymouth City Center, UK. Cann, 51, and Bailey, 41, both pleaded guilty to violent disorder and were sentenced at Plymouth Crown Court. Cann received a three-year sentence, while Bailey was sentenced to 30 months.
Prosecutor Lewis Aldous described how Cann, with 26 convictions for 170 offenses, threw a firework during the chaos. Bailey, who had 24 convictions for 39 offenses, was caught throwing a can while chanting, "refugees not welcome here." Both men had lengthy criminal records, including theft, robbery, and drug offenses.
In their defense, Cann’s advocate mentioned his history of Post-traumatic Stress Disorder, anxiety, and a difficult upbringing. Bailey’s advocate expressed his remorse and current homelessness. However, Judge Linford did not hold back, condemning their actions and pointing out their hypocrisy.
During sentencing, Judge Linford delivered a stinging rebuke, stating: “So let's look at how the taxpayer has been funding your activities over the last 38 years—let's see what you've cost the country: you've got 10 aliases, four fictitious birth dates, you're 51 years of age, you've been convicted of 170 offenses... you’ve received sentences totaling 357 months in prison.” He then emphasized, "You have no right whatever to say who should or should not be in this country."
To Bailey, Judge Linford pointed out his 29 convictions, including theft, drug offenses, and robbery, and criticized him for "chanting with the rest of that rabble about immigration." He firmly stated, "You two were in no position to judge anybody."
The judge’s remarks have been widely praised on X (formerly Twitter), with many users applauding his firm stance. One user commented, “What a fantastic response from the judge. I hope they are made to do the actual math.” Another highlighted the importance of context, noting that many of these offenders “provide zero to society.”
