Judge Goes Viral for Savagely Putting Rioters in Their Place

A 28-year-old transgender man, Hari Devageeth, has moved the Kerala High Court after KIMS Hospital in Thiruvananthapuram allegedly refused to freeze and store his eggs, citing his gender identity. Devageeth, who was assigned female gender at birth but currently identifies himself as a male, has undergone breast removal surgery but has not yet completed sex reassignment surgery.

In his plea, he argued that preserving his eggs before the next stage of his transition was crucial for securing his reproductive choices in the future. He further argued that denying him access to egg cryopreservation violates his fundamental rights under Article 21 of the Constitution, which guarantees reproductive autonomy and access to healthcare. He also cited the Transgender Persons (Protection of Rights) Act, 2019, and Kerala's 2015 Transgender Policy, both of which prohibit discrimination in medical services.
The High Court Single Judge-Bench of Justice CS Dias, after taking a note of the petition has issued notices to KIMS Hospital, the State Government, the Union Government, the Director of the Social Justice Department, and the National Assisted Reproductive Technology (ART) and Surrogacy Board.
The matter is scheduled for hearing on 18th February, 2025.
