In a Special Leave To Appeal (Criminal) against a decision of the Telangana HC, wherein a plea by a Muslim man (Husband) against the directions of the Family Court to pay an interim maintainence of Rs.20,000 p.m. to his divorced wife, was dismissed, and HC directed him to pay an interim maintenance of Rs.10,000 p.m., the SC Bench consisting of Justice B V Nagarathna & Justice Ausgustine George Masih, in separte but concurring judgements held that divorced Muslim woman can file a claim for maintenance under Section 125 of CRPC against her husband.
