BLA Knocks on Bombay High Court’s Door: Demands Standardized Mentioning Procedure

Calling for a uniform procedure of mentioning across all the benches, The Bombay Lawyers Association (BLA) has approached the Bombay High Court.
A Bench of Justice AS Gadkari and Justice Kamal Khata listed the matter filed by advocate Eknath Dhokale for further hearing on February 27, 2025.
The petition is the representation of the hassle experienced by advocates as the format of mentioning is different for judges. While some permit oral mentioning, some seek written precipe, others have mandated the use of online forms and some insist on in-person submissions to court clerks.
It has been argued that these procedural discrepancies in the process of mentioning cases infringe upon the fundamental right to access justice and undermine the principles of natural justice.
To address this, BLA has proposed the introduction of an automated listing system that would ensure all newly filed matters are placed before the relevant bench within four days, eliminating the need for mentioning altogether.
The matter is listed for hearing on February 27, 2025.
