Allahabad HC Sets Aside Afzal Ansari's Conviction, Allows Him to Continue as MP
Chief Justice of India D.Y. Chandrachud, on October 1, 2024, expressed strong disapproval of the practice where multiple lawyers seek urgent hearings for the same case, compromising his "personal credibility." The CJI's comments came during court proceedings after a lawyer mentioned a case involving a lapsed mining lease for an urgent hearing.
The Chief Justice noted that some lawyers attempt to secure a favourable listing by repeatedly presenting the same case, each time changing advocates. Addressing this issue, he stated, "Stop this practice of repeated mentioning by different counsels. All of you are just trying to take a chance. Whatever little discretion I have as the Chief Justice will never be exercised in your favour, because there is an attempt to take this court for a ride."
CJI Chandrachud further elaborated on the consequences of such tactics, adding, "Get three different counsels and see... the judge blinks and you get an order. This is what is happening in this court. I will not do it. Because my personal credibility is at stake."
CJI's comments accentuated his determination to maintain the integrity of the judicial process, warning lawyers against taking advantage of procedural loopholes to get their cases listed.
