Allahabad HC Sets Aside Afzal Ansari's Conviction, Allows Him to Continue as MP
Upholding a sentence of the trial court sentencing a man to death in a ‘rarest of rare’ case the Bombay HC division bench of Justice Revati Mohite Dere and Justice Prithviraj Chavan pronounced their judgment handing capital punishment to a convict who, on August 28th 2017, killed his mother in what was delineated as a ‘most cruel case’ by the prosecution.
The case of murder so chilling happened in Kolhapur, on August 28th 2017, committed by Sunil Rama Kuchkoravi, who killed his mother of 63 years for refusing him money to buy liquor as detailed by Additional Public Prosecutor (APP), appearing for the State. The prosecution had twelve eyewitnesses testify to the murder and police on its part investigating the case said they put together forensic evidence and DNA tests of body parts that matched those of the murdered woman. Adducing the ‘condition of the dead body’ and ‘site of the murder’ as crucial and clinching evidence the prosecution stated that this was a ‘most cruel’ case.
When trial court Judge, Mahesh Jadhav proclaimed it as a ‘rarest of rare case’ fit for nothing less than a death sentence in 2021, such an order becomes executable only when the High Court confirms it. The convicted felon, now 38, had not filed an appeal against the conviction and sentence. Hence a confirmation case was filed by the State in 2021, after the sessions court in Kolhapur handed down a sentence of death by hanging to the accused.
Ratifying the capital punishment of the trial court stating that there was no flaw in its ruling, the High Court had reserved the appeal and confirmation of case for judgment on August 8th. A reasoned and detailed judgment copy will soon follow stated the Bench no sooner they pronounced their judgment on 1st October 2024..
