Allahabad HC Sets Aside Afzal Ansari's Conviction, Allows Him to Continue as MP
Justice Manoj Kumar and Justice Ujjal Bhuyan of the Supreme Court are set to review a plea filed by parents who are seeking criminal proceedings against a hospital. The allegation centres on the hospital supposedly swapping their newborn boy with a girl immediately after delivery.
This case challenges the decision of the Chhattisgarh High Court, which declined to order registration of a First Information Report (FIR) against the director of a private hospital in Raipur and his wife, who is the gynaecologist at the same hospital. The accusation involves the serious charge of kidnapping an infant right after birth.
Facts:
The petitioners claimed that they delivered twins—a boy and a girl—at the private facility, but soon afterward discovered that instead of having one boy and one girl, they had two girls.
Following their complaint, a DNA test was conducted which confirmed that the DNA of one of the girls matched the biological parents, while the DNA of the other girl did not correspond to them. According to the petitioners, "It was a clear case of child swapping."
They argued that their case warranted a thorough inquiry and that the investigation should have been initiated promptly. However, the High Court dismissed their petition summarily without a detailed examination of these critical issues.
Previously, the High Court had rejected the petition based on a report from an Enquiry Committee comprising six expert doctors, who found no evidence of wrongdoing or misconduct by the hospital. The dispute continues to revolve around these conflicting findings and the demands for justice by the affected parents.
The Supreme Court acknowledged that the matter deserved careful consideration and has scheduled the hearing to take place after four weeks.
