Allahabad HC Sets Aside Afzal Ansari's Conviction, Allows Him to Continue as MP

The Supreme Court refused to cancel the bail granted to a cardiologist accused of performing angioplasty procedures on healthy patients or without their consent, to wrongfully claim money under the Pradhan Mantri Jan Arogya Yojana (PM-JAY).

A Division Bench of Justice JK Maheshwari and Justice Atul S Chandurkar allowed the doctor to remain on bail and directed that he must cooperate with the trial proceedings.
Facts:
The case stems from allegations of medical negligence and fraud linked to a rural health camp. A medical camp was organised by Khyati Hospital in Borisana village on 10.11.2024, where 89 people were examined. Out of them, 19 patients were referred to Khyati Hospital for further tests. After doctors advised angioplasty, the Respondent cardiologist allegedly performed the procedure on seven patients, and two of them later died due to complications from the surgery.
It is alleged that the Respondent (doctor) did not take consent from the patients and even carried out some angioplasties when they were not medically necessary. An FIR was lodged at Sola, Ahmedabad, and the doctor was booked under sections 105, 110, 336(2), 340(2), 318 and 61 of the BNS.
In May 2025, a bench of the Gujarat High Court refused to grant bail to the Respondent, observing that there was a strong prima facie case against him. The court also accepted the prosecution’s argument that the acts were an orchestrated attempt to “mint more money” from the government and went beyond simple medical negligence.
The Respondent then approached the Supreme Court, but later withdrew the petition. He subsequently filed a second bail application before the High Court, which was allowed by the impugned order in December.
Court’s Order:
The Supreme Court ultimately upheld the Respondent’s bail, noting that he had already spent 1 year in pre-trial detention. The Court also said the State would be free to seek cancellation of bail if the Respondent becomes involved in any other criminal case.
