Abuse of Law: SC Dismisses Sukash Chandra Shekhar’s Plea for Jail Transfer

The Supreme Court on 18th February, 2025 dismissed a writ petition filed by an alleged conman Sukash Chandrashekhar, who is facing 27 cases, including extortion charges, seeking a transfer from Mandoli jail to Karnataka or any state where the Aam Aadmi Party (AAP) is not in power. A bench of Justice Bela M. Trivedi and Justice PB Varale noted that this was the fourth such petition filed by Chandrashekhar, calling it an abuse of process of law.

The Court initially remarked that his plea had become irrelevant since AAP is no longer in power in Delhi. However, after learning of his repeated legal filings, the Court dismissed the petition, warning him against further misuse of the legal system.

Chandrashekhar’s counsel, Senior Advocate Shoeb Alam, argued that his client had been imprisoned in Delhi for over six years and sought a transfer to be closer to his ailing 70-year-old mother in Karnataka. He contended that the trials were still in the early stages, with a large number of witnesses yet to be examined, and that no pending investigations justified keeping him in Delhi.

However, the bench questioned the necessity of the plea, highlighting that a similar request had already been rejected. Justice Trivedi expressed concern over repeated petitions wasting judicial time and suggested that the petitioner's financial resources allowed him to exploit legal avenues endlessly.

The Court remained firm in its stance, rejecting arguments about Chandrashekhar’s rights under Article 21 of the Constitution. Justice Trivedi stated that fundamental rights cannot be enforced at the cost of public safety and questioned the petitioner’s repeated allegations against jail officials.

Justice Trivedi also dismissed the Senior Advocate’s argument that Chandrashekhar was innocent until proven guilty, remarking, “No Court will grant you bail,” given the severity of the charges.

Justice Trivedi also went on to make a sharp comment, asking whether his mother would even want to see a son like him, signaling the Court’s firm disapproval of his actions.
