Allahabad HC Sets Aside Afzal Ansari's Conviction, Allows Him to Continue as MP
The Supreme Court Bench of Justice B.R. Gavai and Justice S.V.N. Bhatti recently had expunged adverse remarks made by a division bench of Bombay High Court against a lawyer in a matrimonial case, stating that the criticism was unjustified.
The Supreme court bench held that there was no suppression of facts by the appellant, as the Family Court’s order was already part of the case record. The High Court had earlier accused the lawyer of concealing the order, calling the conduct "reprehensible."
“We find that the High Court was not justified in making the observations against the appellant herein, inasmuch as the order of the Family court was very much on record. As such, there could be no question of suppression of facts. We, therefore, expunge the observations made in paragraph 10 of the impugned judgment and order dated 05.09.2024 passed by the Division Bench of the High Court.” the Supreme Court observed.
